An LMIA is a document issued by Employment and Social Development Canada (ESDC) that proves a Canadian employer needs to hire a foreign worker because no Canadian citizen or permanent resident is available for the job. A positive LMIA supports the employer’s application for a foreign work permit.
There are two main types of work permits in Canada: employer-specific and open work permits. Most employer-specific permits require an LMIA. Without it, the foreign worker cannot legally be hired. The process can be complex and time-consuming, involving advertising requirements, wage compliance, and documentation.
Some LMIA exemptions exist, such as under international trade agreements or the International Mobility Program. However, most workers and employers benefit from working with an immigration lawyer to ensure compliance.
