What Happens After You Apply?
Eligibility Assessment – A government officer will determine if your claim can be referred to the Refugee Protection Division (RPD).
Hearing at the RPD – You’ll need to prove that you meet the legal definition of a refugee or person in need of protection.
Decision – If successful, you’ll be granted Protected Person status and can apply for Permanent Residence in Canada.

Who Can Make a Refugee Claim?
You may be eligible to apply for refugee protection in Canada if you are:
A Convention Refugee — fearing persecution due to race, religion, nationality, political opinion, or membership in a specific social group
A Person in Need of Protection — at risk of torture, death, or cruel and unusual punishment if returned to your country
Claims are typically submitted online through IRCC’s asylum portal after arriving in Canada. In some cases, applications can also be made at a port of entry or through CBSA officers.
Safe Third Country Agreement (STCA)
If you’re coming to Canada through the U.S., your eligibility may be affected by the STCA. There are exceptions, including:
Family members in Canada
Unaccompanied minors
Valid Canadian visas or permits
Public interest grounds
